Suda Saunas Inc. is proud to partner with Niche Winery Company Ltd. to provide a unique sauna experience. These Terms and Conditions govern your use of our services and participation in events held at the Winery’s premise


1. Agreement to Terms

By booking a session with Suda Saunas Inc. (“We”, “Us”, or “Our”) through our online platform, you (“You” or “Your”) agree to these Terms and Conditions. This constitutes a binding agreement between You and Suda Saunas Inc. By booking a session and participating in any Suda Saunas Inc. event, You confirm that You have read, understood, and agree to be bound by these Terms and Conditions, as well as any applicable rules or guidelines provided at the event. If You do not agree to these Terms, please refrain from making a booking.

2. Payment and Booking Policy

Full payment is required at the time of booking to confirm Your reservation. By proceeding with payment, You agree that all sales are final, and no refunds will be provided for any reason, including but not limited to cancellations by You, no-shows, or late arrivals. Late arrivals will not extend the reserved time slot, and no refunds or adjustments will be made for participants who arrive late.

3. Refund and Cancellation Policy

All sales are final. No refunds will be provided for any cancellations by You or for events canceled by Suda Saunas Inc. Any exceptions to this policy are at the sole discretion of Suda Saunas Inc. and will be communicated in writing.

4. Refunds for Exceptional Circumstances

While all sales are final, Suda Saunas Inc. may, at its sole discretion, provide partial refunds or credits for future bookings if participants are unable to attend due to documented emergency situations, such as medical emergencies. Participants must provide supporting documentation to be considered for a refund or credit.

5. Waiver Requirement

Participation in any sauna session is contingent upon signing a waiver prior to the start of the session. Failure to sign the waiver will result in denied entry, and no refund will be issued. The waiver shall also apply to Niche Winery Company Ltd. and its officers, employees, and affiliates.

6. Health and Safety Acknowledgment

By participating in any sauna, Cold Plunge, or aromatherapy activities, You confirm that You are in good health and fit to engage in such activities. You agree not to participate if You have any medical conditions (e.g., heart problems, high blood pressure, respiratory issues) that could be adversely affected. You take full responsibility for consulting with a healthcare provider prior to participation if needed.

7. 4. Liability and Assumption of Risk

You acknowledge that participation in sauna activities and related services involves inherent risks, including but not limited to heat-related illnesses, burns, slips, and personal injury. This includes the use of:

  • Sauna: You acknowledge that sauna usage involves exposure to high temperatures that can result in overheating, dehydration, burns, or other heat-related health issues. You agree to use the sauna at your own risk and assume full responsibility for any injuries or health complications that may arise from its use.
  • Cold Plunge: You acknowledge that Cold Plunge usage involves exposure to cold temperatures that can result in physical stress, shock, or other health-related issues. You agree to use the Cold Plunge at your own risk and assume full responsibility for any injuries or health complications that may arise from its use.
  • Aromatherapy: You understand that aromatherapy may involve exposure to essential oils or other substances that could cause allergic reactions or respiratory issues. You agree to use any aromatherapy options provided at your own risk and assume responsibility for any adverse reactions or health issues resulting from its use.

You understand and accept that participation in any Suda Saunas Inc. activity involves potential risks, including but not limited to physical injury, illness, or loss of personal property. Suda Saunas Inc. is not liable for any incidental, indirect, or consequential damages arising from Your participation. You agree that You are solely responsible for assessing whether Your physical condition permits safe participation.

You agree to release and hold harmless Suda Saunas Inc., Niche Winery Company Ltd., and their officers, employees, and affiliates from any and all claims, damages, or liabilities arising from Your participation in the sauna, Cold Plunge, or aromatherapy activities, whether due to negligence or otherwise. This includes any claims that may arise against Niche Winery Company Ltd. as a result of Your participation.

8. Indemnity Clause

You agree to indemnify and hold harmless Suda Saunas Inc., its officers, employees, and affiliates from any claims, damages, or liabilities brought by third parties as a result of Your actions during the event.

9. Limitation of Liability

At no time shall Suda Saunas Inc.’s liability under this Agreement exceed the greater of: (a) the booking fee paid by You to Us; or (b) One Thousand ($1,000.00) Dollars. This limitation applies to all claims, whether based on contract, tort, or any other legal theory. Suda Saunas Inc. shall not be liable for any indirect, punitive, special, or consequential damages arising from or connected with Your use of our services or participation in our events, including but not limited to lost profits, lost data, or any other intangible losses. You acknowledge that Suda Saunas Inc. has made this limitation of liability a condition of entering into this Agreement.

10. Compliance Disclaimer

Suda Saunas Inc. makes reasonable efforts to comply with all applicable municipal, provincial, and federal laws and regulations. However, We shall not be held liable for unintentional non-compliance with any by-laws, health regulations, or other applicable laws that were not reasonably known or were subject to interpretation at the time of service. It is understood that the participant assumes responsibility for verifying that all activities are permissible under the applicable local laws and regulations.

11. Event Suspension or Cancellation Due to Compliance Orders

In the event that Suda Saunas Inc. is ordered by a regulatory authority to cease operations or stop current or future events due to non-compliance with any municipal, provincial, or federal laws, Suda Saunas Inc. shall not be held responsible for any repayments or compensation beyond the booking fee paid by participants. No additional compensation or damages will be provided.

12. Force Majeure

Suda Saunas Inc. shall not be held liable for any failure to perform, or any delay in the performance of, any of our obligations under these Terms and Conditions if such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, strikes, lockouts, government regulations, or any other events that could not have been reasonably foreseen or avoided (“Force Majeure Event”). In the event of a Force Majeure Event, Suda Saunas Inc. reserves the right to cancel or reschedule events without any obligation to refund or compensate participants.

13. Severe Weather and Emergency Policies

Suda Saunas Inc. shall not be liable for any adverse weather conditions (e.g., cold, wind, rain) that affect the event experience. No refunds will be provided due to weather unless the event is officially canceled by Suda Saunas Inc. In the event of severe weather or other emergencies that may force the event to be rescheduled or canceled, Suda Saunas Inc. will notify participants as soon as possible. Our liability in such cases will be limited to the booking fee refund, with no further compensation provided.

14. Modification or Rescheduling of Events

Suda Saunas Inc. reserves the right to modify or reschedule events as needed due to operational, logistical, or other reasonable causes. In such cases, Suda Saunas Inc.’s liability will be limited to a refund of the booking fee.

15. Event Termination Clause

Suda Saunas Inc. reserves the right to terminate any event or session early if safety or operational concerns arise. In such cases, Suda Saunas Inc.’s liability will be limited to a refund for the unused portion of the booking, and no further compensation will be provided.

16. Participant Conduct Clause

You agree to behave respectfully and follow all posted safety rules and staff instructions. Failure to comply with these rules or engaging in disruptive behavior may result in Your immediate removal from the event without refund.

17. No Smoking or Vaping Policy

Smoking and vaping of any kind are strictly prohibited within the sauna area. Violation of this policy may result in removal from the area without a refund.

18. Age Restrictions

Participants must be at least 18 years of age. Minors under 18 must be accompanied and supervised by an adult at all times.

19. Lost or Stolen Items

Suda Saunas Inc. will provide enclosed boxes for participants to store their belongings. These boxes are not lockable but are kept in a designated safe area under camera surveillance. Despite these measures, Suda Saunas Inc. is not responsible for any lost, stolen, or damaged personal property during the event. Participants are advised to use the storage boxes at their own discretion and take any additional precautions they deem necessary.

20. Photo and Video Consent

By participating in Suda Saunas events, You consent to being photographed or recorded. You agree that these images and recordings may be used for promotional purposes by Suda Saunas Inc. without compensation or prior approval.

21. Feedback and Dispute Resolution

Suda Saunas Inc. encourages participants to provide feedback about their experience. For any concerns, participants are advised to contact Suda Saunas Inc. using the contact form available on the sudasaunas.com website. Positive feedback may be used as a testimonial on the Suda Saunas Inc. website or in other promotional materials, without compensation or prior approval. In the event of a dispute, Suda Saunas Inc. will make reasonable efforts to resolve the issue through good faith discussions. If a resolution cannot be reached, participants agree to submit to mediation as a preliminary step before pursuing legal action. Mediation will be conducted in accordance with the rules of a mutually agreed-upon mediation service in British Columbia.

22. Data Privacy and Sharing

By booking a session, You consent to the collection and use of Your personal information for booking purposes, service delivery, and marketing purposes. Your contact information will be shared with Niche Winery Company Ltd. for customer service, marketing, and promotional purposes in line with our partnership to enhance your experience.. We comply with all applicable data privacy laws to ensure Your data is protected and used solely for the purposes outlined in this Agreement.

23. Notification of Changes

Suda Saunas Inc. will inform participants of any changes to event details via email. Additionally, Niche Winery Company Ltd. will be notified of any significant changes affecting the event. It is the participant’s responsibility to ensure that the contact information provided is correct and up to date, and to monitor communications for any updates.

24. Reservation of Rights

Suda Saunas Inc. reserves the right to refuse service or entry to any participant at its discretion, especially if participants are found to violate safety or conduct rules.

25. Disclaimer of Warranties

Suda Saunas Inc. provides services on an “as-is” basis without warranties of any kind, whether expressed or implied. This includes, but is not limited to, warranties of merchantability or fitness for a particular purpose.

26. Service Commitment

Suda Saunas Inc. commits to providing high-quality sauna experiences in collaboration with Niche Winery Company Ltd., ensuring a memorable and enjoyable visit for all participants while providing the following services and operational standards for sauna sessions held at the Winery’s chosen location:

  • Sauna and Cold Plunge Provision: Suda Saunas Inc. will provide one mobile, wood-fired sauna (including a small change room) and a cold plunge pool at the designated location on the Winery’s property.
  • Safe Operation and Supply: Suda Saunas Inc. will ensure that the saunas are operated safely and that there is a sufficient supply of wood to maintain proper sauna operation throughout the scheduled sessions.
  • Guest Support and Amenities: Suda Saunas Inc. will offer guests basic training on sauna use, as well as bath towel rental, bathrobe rental, and other necessary amenities (e.g., aromatherapy) to enhance the sauna experience.
  • Onsite Staff Presence: At least one Suda Saunas Inc. staff member will be present onsite during defined “Regular Hours” (12 PM to 8 PM) to assist sauna clients with setup, guidance, and any necessary support.
  • Adherence to Regular Hours: Suda Saunas Inc. will ensure that no sauna bookings or sauna use take place outside of the defined “Regular Hours.”
  • Timely Departure: Suda Saunas Inc. will ensure that all sauna staff and sauna guests vacate the Winery property no later than 15 minutes after the conclusion of “Regular Hours” each day.

27. Division of Responsibilities

Suda Saunas Inc. shall be responsible for providing and managing the sauna-related services and amenities as outlined in this Agreement, including snow clearance within the designated sauna area. Any additional facilities, services, or support required for the overall operation and comfort of the event—such as property-wide snow clearance outside of the sauna area, parking, restrooms, complimentary water stations for visitors to fill their own bottles, purchasable drinks and snacks, and a seating area—are the responsibility of Niche Winery Company Ltd. or the property owner. Suda Saunas Inc. shall not be held liable for any shortcomings or issues related to these services that fall outside of its control and operational scope.

28. Legal Fees

In the event a dispute arises regarding this Agreement, the prevailing party shall be entitled to recover its reasonable legal fees, in addition to any other relief to which it is entitled.

29. Entire Agreement

These Terms and Conditions constitute the entire agreement between You and Suda Saunas Inc. regarding the use of our booking platform and participation in sauna events.

30. Non-Waiver of Rights

Our failure to enforce any of Our rights under this Agreement or at law shall not be deemed a waiver or a continuing waiver of any of Our rights or remedies. Any waiver of any provision of these Terms and Conditions will be effective only if in writing and signed by an authorized representative of Suda Saunas Inc.

31. Severability

If any provision of this Agreement is judicially determined to be invalid, void, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid, void, or unenforceable provision shall be replaced by a valid provision that most closely matches the intent of the original provision.

32. Notification of Changes

Suda Saunas Inc. will inform participants of any changes to event details via email. Additionally, Niche Winery Company Ltd. will be notified of any significant changes affecting the event. It is the participant’s responsibility to ensure that the contact information provided is correct and up to date via sudasaunas.com contact form, and to monitor communications for any updates.

Suda Saunas Inc. and Niche Winery Company Ltd. encourage participants to provide feedback about their experience and will collaboratively address any concerns through the contact form available on the sudasaunas.com website. Positive feedback may be used as a testimonial on the Suda Saunas Inc. website or in other promotional materials, without compensation or prior approval. In the event of a dispute, Suda Saunas Inc. will make reasonable efforts to resolve the issue through good faith discussions. If a resolution cannot be reached, participants agree to submit to mediation as a preliminary step before pursuing legal action. Mediation will be conducted in accordance with the rules of a mutually agreed-upon mediation service in British Columbia.

34. Participant Responsibility for Damages

Participants agree to be held responsible for any damage they cause to the sauna, Cold Plunge, or any related facilities during their participation in the event. In the event of damage, participants will be liable for the cost of repairs or replacements as determined by Suda Saunas Inc. Participants will be notified of the damages and the associated costs, which must be settled within 30 days of receiving the notice. Failure to do so may result in further legal action to recover the costs.

35. Sustainability Commitment

Suda Saunas Inc. is committed to environmental sustainability and responsible resource management. We utilize recycled products for our wood fuel, ensuring that our operations minimize waste and reduce our carbon footprint. We encourage our participants to embrace eco-friendly practices during their visit and appreciate any efforts to support sustainability initiatives within the Winery. By participating in our services, you contribute to our mission of promoting sustainable practices in wellness and recreation.

Acceptance of Terms
